Premier Li Keqiang of the State Council presided over to hold executive meeting of the State Council on Dec. 9, deployed promoting central enterprises to improve efficiency and upgrade, listened to the report from board of supervisors on supervision and inspection situation to central enterprises; determined to reform and improve the measures of intellectual property system, guaranteed and stimulated the public to start up business and innovation of millions of people; authorized the State Council to adjust the determination draft applicable to the relevant provisions of Securities Law of the People's Republic of China and Law of Traditional Chinese Medicine (Draft) in implementation of stock issuance registration system reform by submitting to Standing Committee of the National People's Congress.

As indicated in the meeting, the performance achieved by central enterprises should be given affirmation, the difficulty shouldn’t be underestimated when being confronted with, reform should be still deepened, and we should take improvement in quality and benefit as centre, comprehensively implement countermeasure, promote central enterprises to overcome difficulties, improve quality and upgrading while struggling in market, and better give play to the supporting function for economic society development.

As emphasized in the meeting, in the next 2 years, we should focus on improvement of quality and increase in efficiency, firstly, closely watch market requirement and intensify innovation, improve supply to increase efficiency, construct the professional “dual creation” platform of central enterprises, promote competitive industries and groups to have deep cooperation with central scientific research institutions, explore and organize science and technology group for those scientific research institutions which mainly assumed industrial common technology research. Centre on emerging industry, exert force and tackle critical problems in key technology, develop “Internet+” and other new types of industry. Drive high-speed rail, nuclear power, smart power grids and other entire industrial chains to go out.

Secondly, reinforce classified guidance, as for those industries and enterprises which are not in conformity with national energy consumption, environmental protection, quality, safety and other standards and those industries and enterprises in long-run loss with excess production capacity, we should suspend their operation or get rid of and regroup them; as for those enterprises in continuous loss over 3 years and not in conformity with structural adjustment direction, we should adopt asset restructuring, transfer of property rights, closing, bankruptcy and other modes to make them “clear away”, clear and dispose “zombie enterprise”, realize significant reduction in amount of loss for those enterprises with operational losses up to the end of 2017; speed up to quit them from the field of main industry, strictly control investment in the industries with excess production capacity, promote more state-owned capital to concentrate towards key industry and key fields in relation with national security, lifelines of the national economy.

Thirdly, boost efficiency increase in management, carry out specific project of “costing control, benefit veto”, increase clearing away of inventory and receivables, energetically compress non-productive expenditure, decrease management level, implement salary benefit linkage, intensify performance evaluation and encouragement restraint, put the responsibility of improving quality and increasing efficiency into practice. Make pilots in marketization and recruit and select manager for them.

Fourthly, speed up reforms such as diversified ownership, strip social function from enterprises, push water supply, power supply, heating supply to separate from property management for transferring comprehensively around the country in 2016, launch getting rid of medical treatment, education and other pilots of public service agencies.

Fifthly, innovate policy support, promote commercial banks to implement disposition of non-performing asset policy, increase the intensity the write-off of doubtful and bad debts of industries with excess production capacity. In the meeting, they also listened to the report of board of supervisors on the supervision and inspection condition of central enterprises, required to improve and perfect supervision system, adopted effective measure around guarantee of preserving or increasing the value of national assets, paid attention to dispose and rectify and reform the found problems, seriously blamed the operation breaking the rules and negative act according to law.

According to the meeting, to speed up the construction of powerful nation with intellectual property by the method of reform, was the important support to implement the strategy of innovation-driven development and encourage the public to start up business and millions of people to innovate.

Therefore, firstly, we should implement more strict intellectual property protection, perfect fast right protection mechanism, enhance force to investigate and treat infringement act, increase the upper limit of legal compensation, and bring deliberate violation of intellectual property into enterprise and individual credit records. Investigate and treat the action to abuse intellectual property exclusion, limit competition and other behaviors according to law.

Secondly, simplify investigation and registration process; realize the on-line registration, application and approval of intellectual property, lower cost in patent application and support.

Thirdly, perfect the intellectual property protection of new fields and new industry types such as on-duty invention, patent permission and other systems, intensify E-commerce, big data, build the deliberation system of significant economic activity intellectual property, improve innovation efficiency.

Fourthly, increase policy supports in finance and taxation, finance and other aspects, establish intellectual property information and operate transaction service platform, establish the intellectual property information disclosure system formed by financial support project, promote patent, trademark, copyright and other basic information to open freely or with low cost, make entrepreneurship and innovation active.

In the meeting, Determination (Draft) On Authorizing the State Council to Adjust for Application in Relevant Provisions of (Securities Law of the People's Republic of China) in Implementation of Stock Issuance Registration System Reform was approved. As ascertained in the draft, within the 2 years from the date to decide implementation, it authorized the public issuance of stocks planned to be traded in Shanghai Stock Exchange, Shenzhen Stock Exchange to implement registration system. After authorization by Standing Committee of the National People’s Congress, the related departments will enact related rules, and will be implemented after consultation in public, and reinforce supervision in process and after process, practically protect investor legitimate interest. In the meeting, Law of Traditional Chinese Medicine (Draft) was approved. The draft focuses on inheriting and carrying forward traditional Chinese medicine, insisting on paying equal attention to support and normalization, intensifying policy support, stipulating the admittance of traditional Chinese medical doctors and clinics in accordance with the characteristics of traditional Chinese medicine and the development demand, traditional Chinese medicine management, talent training and other systems. As determined by meeting, the above draft will be submitted to Standing Committee of the National People's Congress for deliberation.
